This Agreement contains the terms and conditions between the Affiliate and the ezLandlordForms website ("ezLandlordForms"). ezLandlordForms is ezLandlord, Inc., ("ezLandlordForms") an Estero, Florida-based company.
Acceptance
By completing the signup process and submitting your Zelle, Venmo or PayPal payment information to become an affiliate, the Affiliate understands that they shall be considered an affiliate of ezLandlordForms, and therefore agree to be bound by the Terms as stated herein
ezLandlordForms Web Site's General Terms and Conditions
In addition to these terms and conditions, the Affiliate is bound by the terms and conditions of the ezLandlordForms website.
Relationship
The relationship between ezLandlordForms and the Affiliate will be that of independent contractors for all purposes and in no event will the Affiliate and/or any person employed or contracted by the Affiliate be considered in any way to be employees of ezLandlordForms. Additionally and specifically, ezLandlordForms is not a member of any partnership, joint venture, or franchise arrangement with the Affiliate. The Affiliate must be a real person. Accounts registered by "bots" or other automated methods are not permitted. The Affiliate must provide ezLandlordForms their legal first name and last name, a valid email address, and any other information that may be requested in order to complete the signup process. The Affiliate must be 18 years or older to be part of this Program.
Term of Agreement
This Agreement shall be for an unspecified term and can be terminated immediately without cause by either ezLandlordForms or the Affiliate providing notice to the other party. Upon termination, the Affiliate will stop using ezLandlordForms material.
PROHIBITION OF FRAUDULENT ACTIVITIES
By participating in the EZLandlordForms Affiliate Program, the Affiliate agrees to adhere to the highest standards of honesty and integrity. The Affiliate expressly undertakes not to engage in or facilitate any fraudulent activities, including but not limited to generating artificial leads, employing deceptive marketing practices, or any other actions that contravene the terms of this agreement. Should the Affiliate be found in violation of these conditions, EZLandlordForms reserves the right to withhold commission payments and, at its discretion, terminate the Affiliate's participation in the program. Such actions are taken to preserve the trust and integrity of our Affiliate Program and ensure a fair and legal operating environment for all participants.
Commissions Exclusion
ezLandlord will not issue commissions for affiliate-generated traffic that replicates or competes with its own trademark, advertising, or promotions.
Prohibited Practices
Affiliates are strictly prohibited from engaging in trademark bidding, utilizing coupon sites, or using terms that closely resemble ezLandlord’s branded keywords. This includes, but is not limited to, terms such as:

Sole Determination
ezLandlord retains exclusive authority to determine instances of unauthorized trademark bidding, coupon site usage, or use of branded keywords.
Compensation
ezLandlordForms shall agree to compensate the Affiliate a commission of fourty percent (40%) of all sales (excluding fees paid to external service providers, fees paid to external suppliers, and subscription renewals) generated directly from the traffic of the Affiliate. This traffic will be given a tracking cookie provided the person has not previously visited ezLandlordForms and has an existing tracking cookie from a different Affiliate. The Affiliate will get credit for the original sale during the life of the tracking cookie. Payments are calculated on the first business day of the month and payment will be sent within five business days when the commissions payable total the amount of $30 or more. Payment will not be issued until the $30 threshold is met initially and subsequently. Renewals are not included as an Affiliate sale and will not be issued a commission. Commissions are paid by Zelle only. The Affiliate is required to have a Zelle account to receive commissions.
Request for Taxpayer Identification
Each Affiliate is required to submit an accurate and up-to-date W-9 tax form (Request for Tax-payer information). These forms may be found at the Internal Revenue Service website. They must be faxed to 866-786-0504 before ANY payments are issued. This tax information is required to be on file in order for affiliate payments to be made.
Limitation of Liability.
ezLandlordForms will not be liable for indirect, special, or consequential damages, or any loss of revenue, profits, or data, arising in connection with this Agreement or the Affiliate Program, even if we have been advised of the possibility of such damages. Further, our aggregate liability arising with respect to this Agreement and the Affiliate Program will not exceed the total commissions paid or payable to the Affiliate under this Agreement.
Indemnification
The Affiliate agrees to indemnify and hold ezLandlordForms, its directors, officers, shareholders, successor and predecessor companies, attorneys, agents, and employees harmless from any claim, demand, or damage, including reasonable attorneys’ fees and costs, asserted by any third party due to or arising out of the Affiliate's actions (including but not limited to advertising, ezLandlordForms web site content or how the Affiliate otherwise direct potential customers to ezLandlordForms).
Trademarks and other Intellectual Property
The Affiliate accepts that all rights in any registered trademarks or any pending trademark registrations associated with the business of ezLandlordForms (i.e., trademarks, service marks, slogans, logos, designs, and other similar means of distinction), including all goodwill pertaining thereto, shall be the sole property of ezLandlordForms. The Affiliate may use and display such trademarks only in the manner and for the purpose allowed by ezLandlordForms, and only during the Term of this Agreement. ezLandlordForms reserves the right to add to, change or discontinue the use of any trademark it owns at any time. The Affiliate shall not use any trademark or trade name of ezLandlordForms in any corporate, partnership or business name without the written consent of ezLandlordForms.
Conduct
The Affiliate agrees to conduct themselves and their business as an Affiliate with consideration of public principles and morals and agree that the Affiliate will not commit any act or thing that will disgrace ezLandlordForms or bring it into public hatred, contempt, scorn or ridicule or that may shock, insult or offend the community or ridicule public morals or decency. Further, the Affiliate will not market or sell ezLandlordForms or products using illegal, unethical, or misleading methods, or through inaccurate content. Affiliates will be removed from the Affiliate Program and forfeit any pending commission earned through fraudulent, illegal, or overly aggressive, questionable sales or marketing methods.
Anti-Spam Policy
Spamming is not allowed and will not be tolerated. Affiliates will be removed from the Affiliate Program and forfeit any pending commission if they are caught spamming. All email campaigns must comply with all elements of the CAN-Spam Act.
Modification to Terms
ezLandlordForms reserves the right to change these terms at any time and to notify the Affiliate by updating and posting these terms on its ezLandlordForms website. ezLandlordForms is not bound by any other modifications to these terms and conditions unless in writing by an authorized ezLandlordForms officer or employee.
Entire Agreement
This Agreement along with ezLandlordForms website terms and conditions constitute the entire agreement between the Affiliate and ezLandlordForms.
Assignment
This Agreement cannot be assigned.
Waivers
Failure on the part of ezLandlordForms, in exercising any right or power under these Terms will not constitute a waiver of such right or power.
Severability
The invalidity or unenforceability of any provision of these Terms or ezLandlordForms website terms and conditions are intended to be read and interpreted independently of each other. If any term, covenant, condition, or provision of this Agreement is held by a court of competent jurisdiction to be invalid, void, or unenforceable, it is the parties' intent that such provision is reduced in scope by the court only to the extent deemed necessary by that court to render the provision reasonable and enforceable and the remainder of the provisions of this Agreement will in no way be affected or invalidated as a result.
Governing Law
The laws of the United States and the State of Florida will govern this Agreement.
Ownership and use of ezLandlordForms Materials
ezLandlordForms material includes any legal materials, documents, contracts, software, products, web links, email, information, or any other materials provided by ezLandlordForms, the ezLandlordForms website or any ezLandlordForms service in any way. ezLandlordForms retains complete ownership to all rights to the ezLandlordForms materials. The Affiliate does not have the right to use or change any of the ezLandlordForms materials without the prior written consent of ezLandlordForms.
End-User
The end-user of the ezLandlordForms website will be subject to ezLandlordForms terms and conditions and disclaimers.
Binding Effect
This Agreement will pass to the benefit of and be binding upon the respective heirs, executors, administrators, successors of ezLandlordForms, and the Affiliate.
Headings
The headings, captions, titles, and numbering system are inserted only as a matter of convenience and may under no circumstances be considered in interpreting the provisions of this Agreement.
